These Terms of Service ("Terms") govern your access to and use of developumaiengine.com, the EVOLUM platform at evolumstudio.com, and any related service operated by Developum AI Inc. ("we," "us," "Developum"). By creating an account or using our services you agree to these Terms.
EVOLUM is a subscription platform for independent filmmakers, actors, investors, and supporters. Developum operates the platform and provides the underlying deterministic engine that turns creative inputs into structured outputs (pitch decks, sizzle reels, analyses, deal-room artifacts).
You retain all rights to the content you upload, generate, or edit on the platform. By using the service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you. We do not use your creative content to train external AI models and we do not license it to third parties.
Your screenplay is yours. Your project is yours. Your deck is yours. We are the workshop, not the owner.
Use of the service is governed by our Acceptable Use Policy. Violations may result in content removal, account suspension, or termination without refund per the enforcement ladder described in the AUP.
The EVOLUM Investor Deal Room and Supporter surfaces facilitate real financial commitments between users. Developum does not custody, escrow, or intermediate funds unless explicitly stated. Payments move between users via Stripe under Stripe's own terms.
Users representing themselves as accredited investors are responsible for their own accreditation status. Users posting projects for financing are responsible for the accuracy of their disclosures and for compliance with applicable securities law in their jurisdiction. Developum provides tools; users provide their own compliance.
Outputs generated by the deterministic EVOLUM engine (pitch decks, analyses, sizzle reels) are provided as-is. You own the outputs generated from your inputs. You are responsible for reviewing outputs before using them externally, especially in contexts that require human-authored disclosure (e.g., certain grants, guild submissions).
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance is announced when possible. Unscheduled outages are handled per our incident response plan (documented at /trust). Availability SLAs for enterprise customers are negotiated separately.
You may terminate your account at any time. We may terminate or suspend your account for material breach of these Terms or the AUP, or if required by law. Upon termination, we delete or return your data per the DPA and our data-retention practices in the Privacy Policy.
The service is provided "as is" and "as available." To the maximum extent permitted by law, Developum disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that all outputs will meet your expectations. Your use is at your own risk.
To the maximum extent permitted by law, Developum's aggregate liability for any claim arising out of or relating to these Terms or the service is limited to the amount you paid us in the 12 months preceding the claim. Developum is not liable for indirect, incidental, consequential, special, or exemplary damages including lost profits or lost data.
You agree to indemnify and hold harmless Developum and its officers, directors, employees, and agents from any claim arising out of your content, your use of the service, or your violation of these Terms, the AUP, or applicable law.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute is resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to their jurisdiction.
We may revise these Terms as the platform evolves. Material changes are announced at least 14 days before taking effect. Continued use after that period constitutes acceptance.
